This Should Not Be Ignored, Child Rape Case Filed Against Donald Trump

An undisclosed "Jane Doe" recently filed a federal suit against the republican presidential candidate Donald Trump, accusing him of raping her in 1994 when she was thirteen years of ages. The mainstream media has largely overlooked this accusation.

If the Bill Cosby case has taught us anything, it is to not overlook rape cases when famous males are involved. Major journalists have actually publicly excused disregarding the Cosby accusers for over a years, notwithstanding the large number of ladies who had stepped forward with trustworthy claims. And now history is repeating itself.

In covering a story, a media outlet is not pointing the finger and shouting guilty. It is simply reporting the news that a lawsuit has actually been filed against Mr. Trump, and ideally putting the problem in context. Unverified claims are simply that - unproven, and ought to be recognized that way. (Mr. Trump's lawyer says the charges are "categorically incorrect, entirely produced and politically inspired.") Evidence comes later on, at trial. However the November election will come well before any trial. And while Mr. Trump is presumed innocent, we are allowed - no, we are bound-- to examine the case's viability now.

No outsider can say whether Mr. Trump is innocent or guilty of these new rape charges. But we can take a look at his record, analyze the court filings here, and make a decision regarding reliability - whether the accusations are credible enough for us to take them seriously and investigate them, bearing in mind his rejection and reporting newly highlighted truths as they establish.

I have done that. And the response is a clear "yes." These accusations are credible. They should not be disregarded. Mainstream media, I'm taking a look at you.

1. Think about the Context: Mr. Trump's Overt, Even Proud Misogyny

The rape case must be viewed through the lens of Mr. Trump's current, longstanding and well documented contempt for women. Guy who objectify women are more likely to end up being perpetrators of sexual violence, simply as one with a long history of overtly racist remarks is most likely to commit a hate crime.

Mr. Trump has delighted in calling females "dogs," "slobs" and "pigs," and cyberstalked and derided reporter Megyn Kelly for having the temerity to ask him to protect his own words. He threw out the most misogynist of attacks, trying to undermine her professionalism by accusing her of menstruating. He's cruelly mocked the look of a female opponent (Carly Fiorina) and an opponent's other half (Heidi Cruz). His campaign even openly acknowledged that it disqualified all women for consideration as his vice-president.

Mr. Trump has a long history of debasing women he's worked with, crossing the line regularly. He's taken lifelong happiness in objectifying females, including his pronouncement: "Ladies, you have to treat 'em like shit."

This can not be ignored. Years of violent language does not make him a rapist. But it does reveal us who the guy is: a callous, meanspirited misogynist who no sane individual would leave alone with her daughter. As Dr. Maya Angelou said, "When somebody shows you who they truly are, believe them."

2. More context: 2 prior sexual attack court claims have actually been made against Mr. Trump

However Mr. Trump has been accused of worse than just misogynist language. 2 prior ladies have implicated Mr. Trump, in court documents, of real or attempted sexual assault. (Mr. Trump denies all the accusations.).

Under oath, Ivana Trump accused Mr. Trump of a violent rape.

First was Ivana Trump, Donald Trump's first spouse, who stated under oath in a 1989 deposition that he had strongly assaulted her, ripped out her hair and by force penetrated her without her permission. In accordance with the Daily Beast, she claims he was hugely upset that she 'd referred him to a cosmetic surgeon who had actually mishandled a "scalp reduction" task (to cover a bald spot) and caused discomfort in his scalp - thus the vindictive yanking on her hair. At the time Ms. Trump stated she felt "violated" by the alleged "rape.".

A few years later on, after their divorce was settled, Ms. Trump claimed that she did not indicate the word "rape" in a "actual or criminal" sense.

Note: essentially every settlement of a case including a high profile individual paying loan to a previous partner - or anyone - requires the person getting the cash to concur in composing to ironclad nondisparagement and privacy. In plain English: you promise to be peaceful and not state anything bad about the party paying you money. This has held true in hundreds of settlement arrangements I have actually dealt with for many years. Ms. Trump was probably contractually prohibited after she signed from stating anything unfavorable about Mr. Trump. And it is also common to attempt to "treat" prior negative declarations with new agreed-to language - like, I didn't indicate it literally. (You didn't suggest forcible penetration literally?).

A service associate implicated Mr. Trump of sexual harassment and "attempted rape".

A 2nd female accused Donald Trump of a sexual attack, in 1997. Inning accordance with The Guardian, then thirty-four year old Jill Harth alleged in a federal claim that Trump violated her "physical and psychological stability" when he touched her totally without approval after her husband went into service with him, leaving her "mentally devastated [and] distraught." The claim called the numerous acts "attempted rape." Soon afterwards she voluntarily withdrew the case when a parallel suit versus Mr. Trump brought by her partner was settled. When The Guardian reached the female in 2016 to ask whether she waited her sexual assault claims, she reacted, "yes.".

In a court filing, according to a report, Ms. Harth alleged that while she and her other half were trying to do a company offer with Mr. Trump relating to a beauty pageant, he repeatedly propositioned her for sex and searched her, culminating in this frightening alleged occurrence:.

Trump powerfully removed (Harth) from public locations of Mar-A-Lago in Florida and forced (her) into a bed room belonging to accused's child Ivanka, in which (Trump) by force kissed, fondled, and restrained (her) from leaving, against (her) will and despite her demonstrations." In the court file, she said that Trump boasted that he "would be the very best lover you ever have.".

Just recently Donald Trump issued a statement that women's claims of sexual harassment, recorded in a prolonged New York Times investigation which included Ms. Harth's lawsuit, were "made up.".

Jill Harth responded madly on Twitter recently: "My part held true. I didn't talk. As usual you opened your big mouth.".

In other words, she is waiting her story.

3. The new Jane Doe child rape claim against Mr. Trump is consistent with verifiable truths about Mr. Trump and his friend Jeffrey Epstein, and has a powerful witness statement connected to it.

A third woman accused Mr. Trump of rape extremely recently. Inning accordance with the Daily Mail, a woman filed an April 2016 claim claiming that when she was thirteen years old she was held as a sex servant to Mr. Trump and his pal Jeffrey Epstein. The lady declared to have a witness, "Tiffany Doe," to the incidents. She filed the case in professional per, that is, without the support of a lawyer.

The case was dismissed by the court for technical filing mistakes. She then obtained a lawyer and the case was modified and refiled in New York federal court, against Mr. Trump and Mr. Epstein.

I have actually carefully evaluated this federal complaint. It is now much stronger than the one she submitted on her own, that makes sense since she now has an experienced litigator representing her. Jane Doe states that as a thirteen year old, she was invited to attend celebrations at the house of Jeffrey Epstein with the guarantee of loan modeling tasks. Mr. Epstein is an infamous "billionaire pedophile" who is now a Level 3 registered sex offender - the most dangerous kind, "a risk to public safety"-- after being convicted of misconduct with another underage female.

Jane Doe says that Mr. Trump "started sexual contact" with her on 4 occasions in 1994. Since she was thirteen at the time, approval is not a problem. If Mr. Trump had any type sexual contact with her in 1994, it was a criminal offense.

On the fourth occurrence, she says Mr. Trump tied her to a bed and by force raped her, in a "savage sexual attack," while she pleaded with him to stop. She says Mr. Trump strongly struck her in the face. She states that later, if she ever exposed what he had actually done, Mr. Trump threatened that she and her family would be "physically hurt if not killed." She says she has remained in fear of him since.

New York City's five year statute of restrictions on this claim - the legal deadline for filing-- has long since run. However, Jane Doe's attorney, Thomas Meagher, argues in his court filing that since she was threatened by Mr. Trump, she has actually been under pressure all this time, and for that reason she should be allowed additional time to come forward. Lawfully, this is calling "tolling" - stopping the clock, permitting more time to file the case. As a result, the grievance alleges, Jane Doe did not have "freedom of will to institute suit previously in time." He cites two New York cases which I have checked out and which do support tolling.

2 uncommon files are connected to Jane Doe's complaints - sworn declarations vouching for the facts. The first is from Jane Doe herself, telling her dreadful story, including the allegation that Jeffrey Epstein likewise raped her and threatened her into silence, and this stunner:.

Accused Epstein then attempted to strike me about the head with his closed fists while he madly screamed at me that he, Epstein, must have been the one who took my virginity, not Accused Trump ...

And this one:.

Accused Trump mentioned that I should not ever state anything if I didn't wish to vanish like Maria, a 12-year-old female that was required to be involved in the third occurrence with Trump which I had actually not seen because that 3rd event, and that he was capable of having my entire household eliminated.

The second declaration is a lot more impressive, due to the fact that it is signed by "Tiffany Doe", Mr. Epstein's "party coordinator" from 1991-2000. Tiffany Doe says that her responsibilities were "to obtain attractive adolescent ladies to participate in these parties." (Teenagers are, lawfully, children).

Tiffany Doe states that she hired Jane Doe at the Port Authority in New York, convinced her to attend Mr. Epstein's parties, and really experienced the sexual assaults on Jane Doe:.

I personally saw the Complainant being required to perform numerous sexual acts with Donald J. Trump and Mr. Epstein. Both Mr. Trump and Mr. Epstein were advised that she was 13 years old.

It is exceptionally rare for a sexual attack victim to have a witness. But Tiffany Doe states:.

I personally experienced 4 sexual encounters that the Complainant was forced to have with Mr. Trump throughout this duration, including the fourth of these encounters where Mr. Trump forcibly raped her despite her pleas to stop.

Tiffany Doe corroborates, based on her own individual observations, just about whatever in Jane Doe's complaint: that twelve year old Maria was associated with a sex act with Mr. Trump, that Mr. Trump threatened the life of Jane Doe if she ever exposed exactly what occurred, which she would "vanish" like Maria if she did.

Tiffany Doe herself states that she remains in mortal fear of Mr. Trump to this day:

I am stepping forward to testify the truthfulness of the physical and sexual assault that I personally experienced of small women at the hands of Mr. Trump and Mr. Epstein ... I testify these facts under the penalty for perjury even though I fully understand that the life of myself and my household is now in serious risk.

Offered all this, and based upon the record thus far, Jane Doe's claims appear credible. Mr. Epstein's own sexual criminal offenses and parties with underage girls are well recorded, as is Mr. Trump's relationship with him 20 years back in New York City. Mr. Trump told a reporter a few years ago: "I have actually known Jeff for 15 years. Terrific guy. He's a great deal of enjoyable to be with. It is even stated that he likes gorgeous women as much as I do, and much of them are on the more youthful side. No doubt about it, Jeffrey enjoys his social life."

Powerfully, Jane Doe appears to have an eyewitness to all aspects of her claim, a witness who appears to have actually put herself in significant risk by coming forward, since at a minimum Mr. Epstein knows her true identity.

Jane Doe has actually not approved any interviews, and we have no idea anything about her background, or Tiffany Doe's, or the information of their stories. Much details needs to be revealed to fully evaluate this case. Maybe they will be challenged on interrogation. Possibly they will recant. But if we're going to hypothesize because instructions, we ought to speculate in the other direction also. Maybe Jane Doe and her lawyer will have more evidence and witnesses to support her claim. Perhaps witnesses from Mr. Epstein's notorious parties will step forward. We just cannot know any of that at this point.

But based on exactly what we do know now, Jane Doe's claims fall directly into the long, ugly context of Mr. Trump's life of misogyny, follow prior sexual misbehavior claims, are supported by an eyewitness, and hence need to be taken seriously. Her claims benefit sober factor to consider and examination.

We live in a world where wealthy, effective guys often utilize and abuse females and ladies. While these allegations might shock some, as a legal representative who represents females in sexual abuse cases every day, I can tell you that regretfully, they are common, as is an accuser's desire to remain anonymous, and her terror in coming forward.

What do you call a country that chooses not to even take a look at sexual assault claims against a guy seeking to lead the free world?

Rape culture.

We neglect the voices of these ladies at our own risk.
